Surveillance is no longer confined to security cameras or intelligence agencies. It has become embedded in the digital systems that shape how we work, communicate, travel, access public services, and participate in society. As governments and private companies increasingly rely on technologies such as facial recognition, artificial intelligence, biometric identification, and data analytics, an important question emerges:
How do we ensure these technologies strengthen society without undermining the rights they are meant to protect?
This question sat at the heart of discussions at the Surveillance Studies Network (SSN) 2026 Conference, where researchers, academics, civil society organisations, and practitioners from around the world gathered to examine the evolving nature of surveillance and its implications for governance, technology, human rights, and democracy.
Representing DigiCivic Initiative, Mojirayo Ogunlana, Executive Director, DigiCivic, and Morisola Alaba-Akinlabi, Programs Coordinator, presented “The Chilling Effect of Surveillance on Digital Rights,” contributing to the global conversations on how surveillance is reshaping civic space and why stronger safeguards are needed to ensure technological innovation remains accountable to the people it serves.
Surveillance Is No Longer Just a Security Issue
The conference theme, “Planetary Surveillance,” reflected a reality that is becoming increasingly difficult to ignore.
Surveillance now extends far beyond monitoring individuals. It is embedded within digital platforms, public infrastructure, workplaces, financial systems, environmental monitoring, artificial intelligence, and global data flows. As societies become more connected, surveillance increasingly becomes part of the infrastructure through which modern life is organised.
One observation from the opening keynote by Emma McCluskey captured this concern powerfully:
“Impunity seems to be an organising principle.”
The remark reflected a recurring concern throughout the conference: surveillance systems often operate with limited transparency and meaningful public oversight while projecting an image of accountability. As surveillance capabilities expand, ensuring democratic oversight becomes just as important as developing the technologies themselves.
The Chilling Effect on Digital Rights
DigiCivic Initiative’s presentation focused on one of surveillance’s most significant but often overlooked consequences: the chilling effect.
The chilling effect describes what happens when people begin to change their behaviour simply because they believe they may be watched. Individuals may avoid expressing opinions online, participating in political discussions, organising within civic groups, or seeking sensitive information, not because they have been directly punished, but because the possibility of surveillance creates fear and uncertainty.
In this way, surveillance can restrict rights without ever imposing a formal sanction.
The presentation examined how the increasing deployment of biometric identification systems, facial recognition technologies, online monitoring, artificial intelligence, and large-scale data retention programmes may affect fundamental rights, particularly the rights to privacy, freedom of expression, freedom of association, and democratic participation.
While surveillance technologies can contribute to legitimate public interests such as national security and crime prevention, DigiCivic Initiative argued that these objectives should never come at the expense of transparency, accountability, and respect for fundamental rights.
When Technology Outpaces Governance
One of the strongest lessons from the conference was that technological innovation is advancing much faster than the governance structures intended to regulate it.
Discussions explored how organisations increasingly rely on algorithms to manage workers, process behavioural data, and automate decision-making. One session examined Amazon’s algorithmic management systems, illustrating how surveillance technologies are used to monitor employee productivity, regulate workplace behaviour, and optimise efficiency with minimal human oversight.
The conference also explored how commercial data collection has evolved into a major economic model, where behavioural information is continuously collected, analysed, and monetised. These developments raise important questions about accountability, transparency, and public trust, particularly where individuals have limited visibility into how decisions affecting them are made.
For DigiCivic Initiative, these conversations reinforced an important point: good governance cannot be an afterthought to technological innovation. Regulatory frameworks, public institutions, and legal safeguards must evolve alongside emerging technologies rather than attempting to catch up after harm has already occurred.
Surveillance as a Social Process
One of the conference’s most thought-provoking discussions encouraged participants to rethink surveillance itself.
Rather than viewing surveillance simply as a collection of technologies, presenters argued that it should be understood as an ongoing social process, one that continuously reshapes institutions, economies, governance systems, and everyday life.
This perspective moves the conversation beyond individual technologies and towards understanding how surveillance influences power, decision-making, and social relationships.
As societies become increasingly digital, surveillance evolves alongside them. It becomes embedded in public administration, commercial services, labour management, healthcare, education, and civic participation.
The conference reinforced DigiCivic Initiative’s view that responding to these challenges requires collaboration across disciplines. Lawyers, technologists, policymakers, researchers, civil society organisations, and affected communities all have an important role to play in ensuring surveillance technologies remain accountable to democratic values.
Moving Beyond Principles to Practical Accountability
Discussions at SSN 2026 reinforced that protecting digital rights requires more than broad commitments to privacy and accountability. It requires practical governance mechanisms that can keep pace with technological change.
For DigiCivic Initiative, this means embedding human rights impact assessments into the design and deployment of surveillance technologies before they are implemented, not after harms have already emerged. Just as environmental impact assessments have become standard practice for major development projects, technologies capable of monitoring individuals at scale should be evaluated for their potential effects on privacy, freedom of expression, equality, and civic participation.
The conference also reinforced the need to strengthen judicial oversight, improve transparency around surveillance practices, and ensure independent institutions have the authority and capacity to hold both governments and private companies accountable.
Ultimately, effective surveillance governance is not measured by how much data can be collected. It is measured by whether institutions can demonstrate that surveillance is lawful, necessary, proportionate, and subject to meaningful public oversight.
Looking Ahead
The conversations at SSN 2026 reaffirmed that surveillance is no longer a future concern. It is already influencing governance, public services, commerce, and democratic participation across the world.
As countries continue adopting artificial intelligence, biometric technologies, and digital identity systems, the challenge will not simply be whether these technologies work, but whether the institutions responsible for deploying them remain transparent, accountable, and respectful of human rights.
